Terms and Conditions

The following represents the studio’s terms and conditions for weddings, portraits and events. These can be modified to the needs of many of the studio’s clients.

Weddings, Portraits and Events: Terms and Conditions
1. It is understood this Studio/Photographer is the exclusive official photographer retained to perform the photographic services requested on this Contract.
2. Studio/Photographer may substitute another photographer to take the photographs in the event of Studio/Photographer’s illness or of scheduling conflicts.  In the event of such substitution, Studio/Photographer warrants that the photographer taking the photographs shall be a competent professional. 
3. No part of any order, including previews, will be delivered until the balance is paid in full.  
4. The Studio/Photographer reserves the right to use negatives and/or digital files and/or reproductions for advertising, display, publication or other purposes.  Negatives and previews remain the exclusive property of this Studio/Photographer. 
5. Upon signature, the Studio/Photographer shall reserve the time and date agreed upon, and will not make other reservations for that time and date.  For this reason, unless the Studio is able to fully replace the cancelled reservation, all deposits are non-refundable, even if the date of the wedding is changed or the wedding is cancelled for any reason. 
6. If the Studio/Photographer cannot perform this Contract due to fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to Photographer’s illness or emergency, then the Photographer shall return the deposit to the Client but shall have no further liability with respect to the Contract.  This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer.  In the event the Studio/Photographer fails to perform for any other reason, the Studio/Photographer shall not be liable for any amount in excess of the retail value of the Client’s order. 
7. Client is aware that color dyes in photography may fade or discolor over time due to the inherent qualities of dyes, and Client releases Photographer from any liability for any claims whatsoever based upon fading or discoloration due to such inherent qualities.
8. The charges in this Contract are based on the Studio’s/Photographer’s Standard Wedding Price List.  This price list is adjusted periodically and future orders shall be charged at the prices in effect at the time when the order is placed.
9. NOTICE OF COPYRIGHT:  It is ILLEGAL to copy or reproduce these photographs elsewhere without Studio’s/Photographer’s permission, and violators of this Federal Law will be subject to its civil and criminal penalties.
10. This Contract incorporates the entire understanding of the parties.  Any modifications of this Contract must be in writing and signed by both parties.

Shipping and Packaging Policy
1. All shipping and packaging costs are to be paid in full by the client before any products are sent to the required address.
2. Depending upon the product, various shipping options are available.
3. Upon request from the client, all shipping options will be given and an alternative to the default can be selected. Unless notified, the default shipping method will be used. Which is usually the most cost effective option available.

Refunds/Cancellations
1. Once a product proof has been approved by the client, no refund on the actual product can be made, unless the product upon arrival is faulty, damaged or different to the proof.
2. The Terms and Conditions above represent the studio’s policy with regards to refunds or cancellations on all weddings, portraits and events.
